1. Introduction

Welcome to Pixae. By accessing or using our AI image creation and editing services at pixae.app (the "Service"), you agree to these Terms of Service ("Terms"). Please read them carefully before using the Service. You must maintain a signed-in account to use any feature of the Service.

2. Service Description

Pixae provides AI-powered image generation, image-to-image editing, and related tools—including background removal, upscaling, photo restoration, image merge, watermark removal, magic eraser, and studio models such as Nano Banana and GPT Image. You must sign in to use any of these features. Access to specific models, resolutions, or higher usage limits may additionally require credits, an active subscription, or payment as shown on the Pricing page.

Pixae is an independent product and interface layer built on in-house systems and third-party model providers. Unless explicitly stated otherwise, Pixae is not affiliated with or endorsed by those underlying providers.

3. User Obligations

By using the Service, you agree to:

• Use the Service in compliance with all applicable laws and regulations
• Not attempt to circumvent usage limits, credit rules, or security measures
• Not use the Service for illegal or unauthorized purposes
• Not interfere with or disrupt the Service or its infrastructure
• Not generate content that violates intellectual property rights or contains harmful material

4. Intellectual Property Rights

Subject to these Terms and applicable law, paid subscribers may use content generated through the Service for personal or commercial purposes, as described on the Pricing page. Free-tier users may use generated content for personal and other non-commercial purposes only, unless Pixae expressly states otherwise on the Pricing page or at checkout.

You are responsible for ensuring that your prompts, uploads, and outputs do not infringe third-party rights, violate applicable law, or breach these Terms.

5. Privacy and Data Protection

Our privacy practices are described in our Privacy Policy. Because all features require sign-in, we collect and retain the account-related information needed to operate your workspace, including generation history, credits, subscriptions, billing, support, and security.

6. Subscriptions, Credits, Billing, and Cancellation

If you purchase a subscription, credits, or other paid features, applicable pricing, billing terms, and entitlements are presented at checkout or on the Pricing page. You can manage or cancel subscriptions from Settings → Billing or through the subscription management portal provided by our payment partner.

Cancellation generally stops future renewals but does not retroactively cancel benefits already provided for the current billing period, unless required by applicable law.

7. Acceptable Use and Prohibited Content

You may not use the Service to generate, upload, or distribute:

• NSFW, sexually explicit, nude, semi-nude, sexually suggestive, pornographic, or other adult-only content
• Content that violates applicable laws or regulations
• Hateful, discriminatory, or harassing content
• Content that infringes intellectual property or privacy rights
• Content intended to exploit, abuse, or harm others
• Violent, deceptive, fraudulent, or otherwise harmful content

We may block, refuse to process, remove, or restrict content or accounts that violate these Terms or create legal, safety, or abuse risks.

8. Refunds and Support

As a general rule, purchases of digital goods, credits, and subscriptions are non-refundable. If you have a billing issue or refund request, contact [email protected]. We review requests on a case-by-case basis and aim to respond within a few business days. Nothing in these Terms limits mandatory rights you may have under applicable consumer law.

9. Service Availability

We strive to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any aspect of the Service at any time. AI outputs may vary in quality and are not guaranteed to meet a particular creative or technical standard.

10. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, Pixae and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
